Florida courts generally believe that parents should provide proper support for their children. In the majority of cases that involve children, there is a custodial parent and a non-custodial parent. A custodial parent is the parent who lives with the children for the majority of the time. The non-custodial parent pays child support to the custodial parent.
The amount of child support is determined by using a table developed by the Florida Legislature. The table takes into account the income of the parents and the number of children. It lists the child support rewarded in those various situations. Child support is based only on the income of the parents, not on the income of new spouses or significant others. Child support is not tax deductable nor can it be claimed as income.
